1. Acceptance of Terms

By accessing or using BlabberBot ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

BlabberBot is an AI-powered video generation service that creates talking head videos from user-provided portrait images and audio files. The Service uses artificial intelligence technology to animate images and synchronize them with audio input.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use this Service.

4. User Content and Responsibilities

You retain ownership of the images and audio files you upload. By using the Service, you represent and warrant that:

  • You have the right to use any images you upload, including necessary permissions from individuals depicted
  • You have the right to use any audio content you upload
  • Your content does not violate any laws, infringe on intellectual property rights, or contain illegal material
  • You will not use the Service to create deceptive, fraudulent, or misleading content
  • You will not use the Service to harass, defame, or harm any person
  • You will not create content depicting minors
  • You will not create non-consensual intimate imagery or deepfakes intended to deceive

5. Credits and Payment

The Service operates on a credit-based system. Credits are purchased in advance and consumed when generating videos. Credit pricing is displayed at the time of purchase. All purchases are final and non-refundable, except where required by law. We reserve the right to change pricing at any time. Unused credits do not expire.

6. Intellectual Property

The Service, including its technology, features, and branding, is owned by BlabberBot and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for its intended purpose. Videos generated using the Service may be used for personal or commercial purposes, subject to these terms.

7. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Create content that promotes violence, hatred, or discrimination
  • Attempt to reverse engineer, hack, or compromise the Service
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization
  • Interfere with or disrupt the Service or its infrastructure

8. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service interruptions. If a video generation fails due to a system error, credits will be automatically refunded.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLABBERBOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless BlabberBot and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

11. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting support.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved in the appropriate courts.
